Refurbishing premises in Menorca: when the activity project must change
A refurbishment can require updated business-activity documentation even if the business keeps its name and operator. The question is what changes: the activity, floor area or capacity under the legal conditions, fire safety or new impacts. Repainting a wall and altering an escape route do not receive the same treatment.
Changes covered by Balearic law
Article 11 of Act 7/2013, in its current wording following the 2026 amendments, distinguishes changes to activities from changes to installations. An increase in the area used or user capacity counts as an activity expansion where it entails new installations or new legally required conditions.
Installation changes must follow the Act where they introduce a new activity, including a complementary one, or expand the activity; the same applies where they alter fire-safety conditions or introduce emissions or impacts that could disturb neighbours. Other work is not classified as a modification for these purposes, but must still meet the relevant technical rules and planning-permission requirements.
Three examples to define the scope
Painting and replacing finishes without changing those conditions may be maintenance. Moving partitions in a shop may affect escape routes, accessibility or fire protection, requiring the layout and existing file to be reviewed. Changing from retail to a laundry introduces another activity, requiring assessment of permitted use, installations, noise, ventilation and its other specific conditions.
These are assessment examples, not automatic classifications based on floor area. Compare the documented premises with the proposed arrangement before commissioning work. A small area does not demonstrate that an alteration is insignificant.
Can the previous project be reused?
Yes, if it can be obtained and provides a reliable starting point. Request it from the previous operator or seek access to the council file with the necessary entitlement or authorisation. Useful records include the project, drawings, certificates, operating authorisation and later alterations. An old licence without plans may not be enough.
The engineer must inspect and compare the records with the premises. Reusing a document is not just changing the operator's name and signing: there may be undocumented alterations. If the project cannot be recovered, the necessary information must be surveyed and the required submission established with the council.
What must be submitted before using altered installations?
For changes to installations in an existing activity that do not introduce a new activity, article 44 requires the activity project to be submitted to the council if not already provided, together with a competent technician's certificate confirming conformity with the amended project and suitability for the activity. This must happen before the completed installations are used.
A new activity follows its applicable procedure, including article 43 for the cases it regulates. Confirm the municipal form and attachments once the scope is clear. Filing documents does not make non-compliant work compliant.
Coordinate activity, building and installation requirements
The activity technician's certificate does not replace the electrical installer's certificate, RITE registration or a mandatory inspection. Activity procedures do not replace building permission either. Where HVAC or escape arrangements change, see the guides to air-conditioning and heat-pump registration and emergency lighting.
Article 11.6 does not require every untouched existing installation to be upgraded indiscriminately, unless sector-specific rules expressly require it. Define the affected work and the actual obligations. Effika can review the records, establish the scope, prepare technical documents and coordinate certification and procedures in Menorca. A quotation should distinguish review, design, supervision, certificates, administrative charges and installers' work.
Frequently asked questions
Can I avoid the procedure if the operator stays the same?
That is not the deciding factor. A relevant alteration may require documentation even with the same operator and activity.
Does building permission allow the business to open?
Not on its own. Activity and installation requirements must also be met, with the necessary documents submitted before use.
Can the same engineer design and certify the work?
Yes, if professionally competent and able to carry out the necessary checks. Each certificate has a specific scope; activity certification does not replace certificates reserved to authorised installation businesses.
